TERMS AND CONDITIONS OF SERVICE

General legal disclaimers and regulations

Passengers participation in activities is solely their responsibility. We reserve the right to deny boarding to additional passengers (please ask the rate for extra passengers). No weapons, corrosive or flammable substances, no illegal substance consumption, drugs or alcohol intoxication, any type of physical or verbal aggression will not be tolerated: any health risk or intoxication warrants immediate return to land. Penalties apply for not following the captain or crew instructions: any vessel damage, misuse or unpaid overtime is responsibility of the lessee/renter; appropriate compensation will be billed or deducted from the security deposit. Smoking, use of sunscreens, creams or oils is permitted only in designated areas; it is prohibited on lounges, benches, chairs, beds, or carpets. Footwear is not allowed on board in most vessels. No changes allowed to established navigation routes. Unauthorized operation of navigation controls, hatches, doors, or any vessel elements is prohibited. We are not responsible for lost or thrown objects at the sea. Connecting external appliances or electronics to the vessel is prohibited unless the captain authorizes it. Exceeding maximum capacity in cabins and bathrooms is prohibited. No pets allowed on board.

Cancellation policies

All reservations require a paid deposit (from 30% to 50% depending on vessel and booking to charter time). Remainder or balance due must be paid before embarking. A Full refund is subject to the time a vessel remained on Hold, Booked or Blocked between the booking date and trip date. Review each case details on Cancellations & Availability Hold. If Captain determines cancellation due to weather conditions, safety concerns, or yacht mechanical failures, a full refund could be issued if the lessee/renter cannot reschedule or postpone the trip. Time of departure changes are allowed. Date changes are allowed within 48hrs after booking (not trip date); any change is subject to availability. Date changes are considered, in most cases, as a new reservation process and might be subject to penalties depending on the case or vessel. Late arrivals do not allow itinerary modifications in most cases (time starts from reservation time), especially when a vessel has been transferred to a different location for pickup.

Weather concerns & policies

The boat goes out no matter the weather, rain or shine, UNLESS the Port or Sea Navigation is closed or restricted; if navigation is allowed within the bay, the route plan and destinations will be shortened or adjusted to match a charter, and a refund will be issued for the difference paid if applicable. Rain does not constitute grounds for cancellation or rescheduling in most scenarios. If Port is Closed or Sea Navigation is restricted due to an extreme weather condition such as: hurricane, lightning storm or tornado when it is dangerous to be in the water, BIP Yachts Charters reserves the right to reschedule the charter with no additional charge or penalty.

Guidelines

Vessel cruising speed is limited, have this considered for each vessel: Sailing boats 6 to 7 knots & power yachts 8 to 10 knots, fishing boats may vary. Speeding up is not permitted on all vessels and it would incur additional fuel expenses (please ask the rate in advance). In any case, delays in returning the vessel result in the lessee being liable for expenses, damages and losses incurred by the lessor and subsequent lessees unable to take possession or even use it appropriately at the scheduled time. Vessel is considered returned once completely vacated by the lessee and all belongings removed. Upon lease/charter termination, a general inspection of the vessel, equipment, rigging, gear, and provisions will be conducted, with the lessee responsible for any damages, faults, or losses except for normal wear and tear. Upon inspection clearance with no liabilities, the security deposit will be refunded, when applicable. If damages, faults, breakdowns, or losses are found, appropriate compensation will be deducted from the security deposit or billed separately, with any remainder refunded by the lessor. Insufficient security deposit funds will be discussed directly with the lessee/renter accordingly.
